CHAPTER I THE MEMBERSHIP

1] The Rules and Regulations about the Membership

Article 1 Purposes

These rules and regulations about the Membership prescribe the matters for the membership which is prescribed in the Articles of Incorporation of ‘General Corporate Juridical Person Japan Sport Wellness Fukiya Association’ (hereinafter referred to ‘The Association’).


Article 2 Kinds of Membership

The Association shall have the following four kinds of membership.
1. Regular Member: General Member of The Association with the qualification of Certified Instructor.
2. General Member: An individual or an organization which approves the purposes of The Association and joins The Association.
3. Support Member: An individual or an organization which joins The Association to support the purposes of The Association.
4. Honorary Member: An individual who contributes a great deal to The Association and/or persons of learning and experience with the approval of the Board of Directors.


Article 3 Procedures for Admission

An individual or an organization which plans to join The Association shall complete the following procedures:
1. Fill out a prescribed application form for admission and submit it to The Association.
2. Annual membership fee shall be paid on admission in accordance with Article 4 of these rules and regulations and shall be paid every year in the month of admission.
3. No admission fee shall be paid.


Article 4 Registration of Membership

4.1 An individual or an organization which is approved the admission by The Association shall be registered on the Membership List of The Association on the day of payment of the annual membership fee.
4.2 A membership card shall be issued by The Association on admission. Fee for reissue of a membership card because of damage and/or loss shall be Yen500.
4.3 When a member joins local area branch, he or she can join only one local area branch.


Article 5 Annual Membership Fee

Annual membership fee, mentioned below, shall be paid every year in the month of admission.
A member himself or herself Yen 3,000
Families of a member live together Yen 1,500 (per person)
From primary schoolchild to university student Yen 500 (per person)
The disabled Yen 1,500(per person)
*When families live together is applicable Yen 1,000 (per person)
Schoolchild through Student with disabled No annual membership fee


Article 6 Obligations of the Members

6.1 Members shall endeavor to promote Sport Wellness Fukiya in order to achieve the purposes of The Association prescribed in the Article 3 of the Articles of Incorporation.
6.2 Members shall follow the relative Laws and shall obey the Articles of Incorporation and rules and regulations of The Association when members conduct promotional activities of Sport Wellness Fukiya prescribed in the preceding Article 6.1.


Article 7 Rights of the Members

Members shall have the following rights:
1. Participate in various meets competitions sponsored by The Association in accordance with the rules and regulations of such various meets and competitions.
2. Take an examination of The Association’s authorized Dan-Kyu-I approval (from 5th Kyu-I to 7th Dan-I).
3. Establish a local area branch authorized by The Association when more than five members gather.
4. Bulletin from The Association shall be sent. However, one bulletin shall be sent to one family.
5. Take examinations for approving various qualifications prescribed in The Association’s rules and regulations.


Article 8 Withdrawal

Members can withdraw from The Association at their discretion by submitting a report of withdrawal with its reason to The Association


Article 9 Considered to be withdrawn

A member shall be considered withdrawn from The Association when he or she did not pay annual membership fee more than one year after due and disagreed with the notification.


Article 10 Expulsion

Members shall be expelled when they fall under the following reasons by the resolution of General Meeting of Members of Representative. In this case, members shall be noticed the expulsion at least one week before the General Meeting with the reason for expulsion and such members shall have the right to defend before the resolution of General Meeting of Members of Representative.
1. Bring dishonor of The Association or act against the purposes of The Association.
2. Violate the obligations of members of The Association.


Article 11 Re-admission

11.1 When he or she plans to re-admit to The Association, he or she shall submit an application form for re-admission and shall pay annual membership fee for the year of re-admission.
11.2 The Association shall confirm the application form for the re-admission and complete the procedures of re-admission on the day of payment of annual membership fee.
11.3 When a member re-admits to The Association, Dan-Kyu-I shall be same as the one when a member withdrew.
11.4 When a member, who was a Certified Instructor, re-admits The Association, he or she shall pass an examination for Certified Instructor again. Duration of the member at the withdrawal shall be added when considering the qualification for the examination.
11.5 A member who was expelled shall not be able to re-admit to The Association by any reason.
11.6 A member who withdrew by some special reason shall be examined its reason and The Association shall take an appropriate procedure in accordance with the rules and regulations prescribed by The Association.


Article 12 Revision

The revision of these rules and regulations shall be resolved at the conference of the Highest Executives through the discussion at the conference of General Managers. Then the revision shall be submitted to the Board of Directors and General Meeting of Representative of Members and shall be resolved, approved and enforced.


Additional Rule

These rules and Regulations shall be enforced as from April 11th 2007.

These rules and regulations shall be revised and enforced as from November 20th 2009.

These rules and regulations shall be revised and enforced as from February 18th 2010.

2] The Rules and Regulations about the Services by Members

Chapter I General Rules

Article 1 Purposes

These rules and regulations about the services by Members prescribe matters for the services made by Members of General Corporate Juridical Person Japan Sport Wellness Fukiya Association (herein after referred to ‘The Association’). These are the rules and regulations for the various services made by the Members in accordance with the request of The Association in order to spread and advance Sport Wellness Fukiya, which is the purpose of The Association.


Chapter II Services

Article 2 Request for the Services

The Association may request to Certified Instructors and Members of The Association to provide their services to the undertakings of The Association.


Article 3 Contents of the Services

Contents of the services shall be instructors at culture schools, staff of the meets, reception of the school as the supporting staff of The Association, answering the telephone, maintenance of the members’ list, holding experimental meetings as the staff of Organization and Education Department, judging Dan-Kyu-I qualification tests, official trip to the meets at the provinces etc.


Chapter III Remuneration

Article 4 Culture School

Remuneration for the instructor of culture schools shall be applied correspondingly to ‘The Rules and Regulations about Culture School’ prescribed separately.


Article 5 Staff of the Meets

Staff of the meets shall be paid no remuneration as volunteer as a general rule, but rules of each meet decided by the meets committee shall be applied correspondingly.


Article 6 Supporting Staff

Supporting staff of The Association shall be considered as volunteer, but shall be paid some remuneration based on its duty.


Article 7 Remuneration for Organization and Education Department

When directors of Organization and Education Department are in charge of judging Dan-Kyu-I qualification test, remuneration shall be paid in accordance with ‘The Rules and Regulations about Dan-Kyu-I Accrediting System’. Other activities made by the Organization and Education Department shall be considered as volunteer, but may be decided case by case based on the contents of the activities.


Chapter IV Accident Insurance

Article 8 Compensation of Accident Insurance

8.1 When the supporting staff and directors of Organization and Education Department etc. pass away or are injured during providing services and/or during the transportation to provide services, which are requested by The Association prescribed in the preceding Article 2, they shall be compensated based on the provisions of Ordinary Collective Group Accident Insurance.
8.2 In case of the occurrence of an accident, details of such accident shall be reported to the Secretariat of The Association without any delay.


Chapter V Other Rules

Article 9 Supplementary Rules

Necessary matters not prescribed in these rules and regulations shall be submitted to the Board of Directors after resolution of the Highest Executives and shall be enforced after the resolution and approval of the Board of Directors.


Article 10 Revision

The revision of these rules and regulations shall be resolved at the conference of the Highest Executives through the discussion at the conference of General Managers. Then the revision shall be submitted to the Board of Directors and General Meeting of Representative of Members and shall be resolved, approved and enforced.


Additional Rule

These rules and Regulations shall be enforced as from February 23rd 2013.

These rules and regulations shall be revised and enforced as from April 1st 2016.

These rules and regulations shall be revised and enforced as from February 16th 2018.


3] The Rules and Regulations about Junior Members

Article 1 Purposes

1.1 Purposes of these rules and regulations shall to establish Junior Membership System for the Junior Members (primary schoolchild and junior high school student) of General Corporate Juridical Person Japan Sport Wellness Fukiya Association (hereinafter referred to ‘The Association’) and to spread and advance Sport Wellness Fukiya to the younger generation.
1.2 Junior Members shall be considered boys and girls up to the 3rd year of Junior High School.


Article 2 Procedures for Admission

2.1 An individual who plans to join The Association shall complete the prescribed application form for admission and written consent of the guardian then shall submit them to The Association.
2.2 In case signature and seal of the guardian are missing at a column of the written consent of the guardian of application form for admission, admission to The Association shall not be permitted.


Article 3 Issuing Membership Card

A membership card shall be issued by The Association on admission. Fee for reissue of a membership card because of damage and/or loss shall be Yen500.


Article 4 Annual Membership Fee

4.1 Annual membership fee of Junior Members shall be Yen 500 per person.
4.2 Annual membership fee of preschool children shall be zero.
4.3 When a Junior Member who joined The Association as preschool child reaches the 1st grade of primary school, he or she shall pay annual membership fee of Junior Member.
4.4 A member shall be considered withdrawn from The Association when he or she did not pay annual membership fee more than one year. This clause shall not be applied for Junior Member of preschool children.
4.5 Students from primary school to university with disabled shall not pay any annual membership fee.


Article 5 Competitions

5.1 Junior Members shall be able to participate with Sport Wellness Fukiya Meet for Junior Members sponsored by The Association.
5.2 Competitions shall be carried out in accordance with ‘The Rules and Regulations about Competitions for Junior Members’.
5.3 In case Junior Members obtain qualification of participating with competitions for General Members, he or she shall be able to participate with these competitions in accordance with qualification of participation of the said competitions. In this case, participation fee shall be same as that of General Members.


Article 6 Examination for Dan-Kyu-I approval

Junior Members shall be able to have examinations of Dan-Kyu-I approval in accordance with ‘The Rules and Regulations about Examinations of Dan-Kyu-I approval for Junior Members.


Article 7 Revision

The revision of these rules and regulations shall be resolved at the conference of the Highest Executives through the discussion at the conference of Junior Bringing up Committee and conference of General Managers. Then the revision shall be submitted to the Board of Directors and General Meeting of Representative of Members and shall be resolved, approved and enforced.


Additional Rule

These rules and Regulations shall be enforced as from December 1st 2009.


Additional Rule

These rules and regulations shall be revised and enforced as from July 1st 2011.


Additional Rule

These rules and regulations shall be revised and enforced as from July 1st 2015.


Additional Rule

These rules and regulations shall be revised and enforced as from April 1st 2017.

These rules and regulations shall be revised and enforced as from February 16th 2018.


4] The Rules and Regulations about the Disabled Members

Article 1 Purposes

1.1 Purposes of these rules and regulations shall to establish Disabled Membership System for the Disabled Members of General Corporate Juridical Person Japan Sport Wellness Fukiya Association (hereinafter referred to ‘The Association’) and to spread and advance Sport Wellness Fukiya widely to the disabled.
1.2 Members of The Association who have handbook of the disabled shall be able to register as the Disabled Members.


Article 2 Procedures for Admission

A disabled individual who plans to join The Association shall complete the prescribed application form for admission and shall submit it to The Association together with a copy of handbook of the disabled (including column mentioning name of disabled) and list of special investigation of the disabled.


Article 3 Issuing Membership Card

A membership card shall be issued by The Association on admission for the Disabled Members.


Article 4 Annual Membership Fee

4.1 Annual membership fee of Disabled Members shall be Yen 1,500 per person. *When families live together is applicable Yen 1,000 per person.
Annual membership fee related to the Disabled Members shall be as follows:
1. Member is the disabled Yen 1,500
Families live together is the disabled Yen 1,000
2. Member is the disabled Yen 1,500
Families live together is not the disabled Yen 1,500
3. Member is not the disabled Yen 3,000
Families live together is the disabled Yen 1,000
4.2 A member shall be considered withdrawn from The Association when he or she did not pay annual membership fee more than one year.
4.3 Students from primary school to university with disabled shall not pay any annual membership fee.


Article 5 Meets

5.1 Disabled Members shall be able to participate with Sport Wellness Fukiya National Meet for the Disabled Members sponsored by The Association.
5.2 Meets shall be carried out in accordance with ‘The Rules and Regulations about the Meets for the Disabled Members’.
5.3 In case Disabled Members have qualification of participating with various meets and competitions, he or she shall be able to participate with any meet and competition sponsored by The Association. In this case, member shall notice that he or she is the Disabled Member on the application form of participation.


Article 6 Examination of Dan-Kyu-I approval

6.1 Disabled Members shall be able to have examinations of Dan-Kyu-I approval. In this case, ‘The Rules and Regulations about General Members’ shall be applied correspondently.
6.2 The Disabled Members shall be able to use assisting tools and/or fixing tools. However, in case a fixing tool is used, “using a fixing tool” shall be mentioned on the certificate.


Article 7 Revision

The revision of these rules and regulations shall be resolved at the conference of the Highest Executives through the discussion at the conference of The Disabled Supporting Department and conference of General Managers. Then the revision shall be submitted to the Board of Directors and General Meeting of Representative of Members and shall be resolved, approved and enforced.


Additional Rule

These rules and Regulations shall be enforced as from December 1st 2009.


Additional Rule

These rules and regulations shall be revised and enforced as from July 1st 2011.

These rules and regulations shall be revised and enforced as from July 1st 2015.

These rules and regulations shall be revised and enforced as from April 1st 2017.

5] The Rules and Regulations about the Corporate Members

Article 1 Purposes

Purposes of these rules and regulations shall to establish Corporate Membership System for the corporate members of General Corporate Juridical Person Japan Sport Wellness Fukiya Association (hereinafter referred to ‘The Association’) and decide the necessary matters to manage such Corporate Members.


Article 2 Standards of the Corporate Members

The Corporate Members shall mean enterprises (employees, staff), schools (pupils, students, staff) and other organizations (staff) which have corporate body with at least five registered members. However, even if Sport Wellness Fukiya Association of the administrative division of Japan, of the local municipalities and local area branches obtain the corporate bodies, such organizations shall not be considered as the Corporate Members.


Article 3 Procedures for Admission

3.1 An organization which plans to join The Association as the Corporate Member shall complete and submit the prescribed application form for admission of the Corporate Members to The Association. The organization shall pay following annual membership fee to The Association and shall be considered as the Corporate Member on the day of payment. The renewal shall be done every year.
Annual Membership fee for School Corporate Member Yen 2,500
Annual membership fee for General Corporate Member Yen 15,000
3.2 The Corporate Members shall be considered same as local area branches of The Association and shall name 〇〇Corporation Sport Wellness Fukiya Club, 〇〇University Sport Wellness Fukiya Club.


Article 4 Registration

4.1 The representative of the Corporate Member shall submit members list to The Association once a year as the representative member. When the members list changes (new member joins and/or some member resigns), representative member shall report to The Association without any delay.
4.2 An individual who belongs to the Corporate Member shall be able to change to General Member. In this case, such individual shall pay an annual membership fee for the General Member as prescribed in ‘The Rules and Regulation about The Membership.


Article 5 Obligations of the Corporate Members

5.1 The Corporate Members shall endeavor to promote Sport Wellness Fukiya in order to achieve the purposes of The Association described in Article 3 of the Articles of Incorporation. 5.2 Corporate Members shall follow the relative Laws, the Articles of Incorporation and rules and regulations of The Association when members conduct promotional activities of Sport Wellness Fukiya described in the preceding Article 5.1.


Article 6 Rights of the Corporate Members

The Corporate Members shall have the following rights:
1. No need to pay an annual membership fee as an individual.
2. Receive the bulletins issued by The Association (3 volumes per the issue).
3. Participate in various meets and competitions sponsored by The Association.
4. Take an examination for the Dan-Kyu-I approval in accordance with the rules and regulations of The Association.


Article 7 Activities

When the Sport Wellness Fukiya Club shall have the activities as the Corporate Member, they shall receive the guidance of the Certified Instructor periodically.


Article 8 Others

The rules and regulations about the activities made by the Corporate Members shall be in accordance with those of General Members.


Article 9 Revision

The revision of these rules and regulations shall be resolved at the conference of the Highest Executives through the discussion at the conference of General Managers. Then the revision shall be submitted to the Board of Directors and General Meeting of Representative of Members and shall be resolved, approved and enforced.


Additional Rule

These rules and Regulations shall be enforced as from June 26th 2014.


Additional Rule

These rules and regulations shall be revised and enforced as from July 31st 2014.

These rules and regulations shall be revised and enforced as from July 1st 2015.

6] The Rules and Regulations about the Support Members

Article 1 Purposes

Purposes of these rules and regulations shall to decide necessary matters of Support Member System as prescribed in the Article 5 of Articles of Incorporation of General Corporate Juridical Person Japan Sport Wellness Fukiya Association (hereinafter referred to ‘The Association’).


Article 2 Qualifications of the Support Members

Individuals, corporations and organizations which approve the aims of The Association and join to support The Association shall be considered the Support Members.


Article 3 Procedures for Admission

3.1 An individual, a corporation and an organization which plans to join The Association as the Support Member shall complete and submit the prescribed application form for admission of the Support Member to The Association and shall be approved by the Board of Directors. A Support Member who is approved to join The Association shall pay the annual membership fee to The Association and shall be registered as the Support Member on the day of payment.
3.2 Annual membership fee shall be paid on admission in accordance with Article 4 of these rules and regulations and shall be paid every year in the month of admission.
3.3 No admission fee shall be paid.


Article 4 Annual Membership Fee

An Individual Support Member: Yen 10,000 (per share, any number of shares is acceptable)
A Corporation/An Organization Support Member: Yen 50,000 (per share, any number of shares is acceptable)


Article 5 Obligations of the Support Members

5.1 The Support Members shall endeavor to promote Sport Wellness Fukiya in order to achieve the purposes of The Association described in Article 3 of the Articles of Incorporation.
5.2 The Support Members shall follow the relative Laws and the rules and regulations of The Association prescribed in the Articles of Incorporation when members conduct promotional activities of Sport Wellness Fukiya described in the preceding Article 5.1.
5.3 The Support Members must not disclose and/or use the closed information of The Association, which has been known as the Support Member, without obtaining an approval from The Association not only during a term of the Support Member but also after withdrawal from The Association. At the same time, The Association shall not disclose and/or use the information about the Support Member without obtaining an approval from the Support Member.


Article 6 Matters to be forbidden

The Support Members shall not do the following conducts:
1. Apply false statements on members’ information etc. to The Association.
2. Act the un-proper conducts which cause infringe on the properties and privacies of other members and/or The Association and give disadvantages or damages to other members and/or The Association, or the un-proper conducts which may do so.
3. Use The Association’s logo, use and divert The Association’s printings without obtaining an approval from The Association.
4. Other conducts which the Board of Directors of The Association judges un-proper.


Article 7 Rights of the Support Members

The Support Members shall have the following rights:
1. Receive the bulletins issued by the Association.
2. Take an examination for the Dan-Kyu-I approval in accordance with the rules and regulations of The Association.
3. Participate in the various meets and competitions sponsored by The Association.
4. Establish a local area branch in accordance with the rules and regulations of The Association.
5. Put up its name on the Web site of The Association as the Support Enterprise (Supporter) and can link its Web site to that of The Association if one desires to do so.


Article 8 Withdrawal

Support Members shall be able to withdraw from The Association at their discretion by submitting a report of withdrawal to the Chairman of The Association. In this case, annual membership fee already paid shall not be re-paid.


Article 9 Expulsion

Support Members shall be expelled when they fall under the following reasons by the resolution of the Board of Directors. In this case, annual membership fee already paid shall not be re-paid.
1. Violate The Association’s Articles of Incorporation and these rules and regulations.
2. Bring dishonor of The Association or act against the purposes of The Association regardless of intentionally or by a mistake.


Article 10 Others

The Association shall be free from any compensation in case the Support Members give damages to the other members and/or the third parties. On the other hand, The Association shall reserve the right to claim compensation for the damages to the Support Members in case the Support Members give the dames to The Association by violating these rules and regulations or acting wrong and/or illegal conducts.


Article 11 Revision

The revision of these rules and regulations shall be resolved at the conference of the Highest Executives through the discussion at the conference of General Managers. Then the revision shall be submitted to the Board of Directors and shall be resolved, approved and enforced.


Additional Rule

These rules and Regulations shall be enforced as from June 26th 2014.
